LSMC 2-059 - Vehicle Tow Regulations [Very Important]

Date of Effectiveness

LSMC 2-059 will be enacted immediately. It will supersede any previous regulations that governed the operation of vehicle tow companies in the City of Los Santos.

Objectives

Establish the procedures vehicle tow companies must comply with in order to operate in the City of Los Santos. Establish the limitations placed upon vehicle tow companies. Establish the legalities that vehicle tow companies must comply with / be aware of.

Vehicle Tow Procedures

* Any vehicle tow company that operates in the City of Los Santos must have a business license by January 1st, 2016 in order to continue operations.

* Any vehicle tow company that tows a vehicle or vehicles must keep a unmolested photograph of that vehicle (prior to towing or contact) on file for no less than two months.

Limitations

* Any vehicle tow company may remove / tow (without expressed permission) any vehicle or vehicles that are parked illegally as defined by LSMC 2-058.

* Any vehicle tow company may remove / tow any vehicle or vehicles as directed by a city agency, such as the fire department, police department or City of Los Santos.

* NO vehicle tow company may remove a vehicle or vehicles from ANY private property, private driveway, alleyway, parking lot, lawn, yard or partition without expressed permission from the owner. NO vehicle tow company may enter ANY private property without receiving expressed permission from the owner or a person designated by the owner.

* Vehicle tow companies may remove a vehicle or vehicles from any area as described above, so long as they are doing it under the direct request / supervision of a city agency such as the police department, fire department or City of Los Santos.

Legalities

* All vehicle tow companies must provide a system in which vehicle owners may contest a vehicle tow / removal, whether it be online, in person, over the phone or through any other form of affirmative communication.

* Any vehicle tow company found to be in violation of LSMC 2-059 is subject to a fine of up to $10,000 per occurrence. This includes removing a vehicle illegally or failing to provide a photograph of a vehicle prior to tow.

* Any vehicle tow company who is found to continuously violate LSMC 2-059 is subject to a suspension of their business license and / or a fine of up to $50,000.

Conclusion

This municipal code was designed and enacted to protect the rightful assets of the citizens of Los Santos. This municipal code was conceived on the basis of multiple complaints received by the City of Los Santos pertaining to the illegal removal of vehicles from private property. This municipal code will be enacted immediately.
